Shvetsova). Developed by the Trade and Industry Ministry of the Russian
Federation the new draft law of modifying in the Rederal Law about the
organisation of non-stationary shopping facilities which is today on
consideration of the State Duma, contains new norms which will return
uncontrollable trade to the city streets. The grave concern was expressed by
the participants of the Association of Volga region cities. The day before the
meeting via videoconference was conducted by Ilsur Metshin, the Mayor of Kazan,
the chairman of the Association of Volga region cities. The heads of cities
decided to prepare a motion to the State Duma about some provisions of the new
draft law on behalf of the Association of Volga region cities taking into
account the opinions of regions and municipalities.
Ildar Shakirov: «The new draft law
in offered edition can take us back to the past»
The new draft law of modifying in
the Rederal Law «About basic principles of State regulation of trade in the
Russian Federation», and the Law about the Сommon principles of the organisation of local self-management in
non-stationary and illegal trade is developed by the Ministry of Trade and
Industry of the Russian Federation. Now it is being prepared for discussion in
the first reading in the State Duma of the Russian Federation and, in spite of
its importance, in today's edition the draft law has given rise to serious
concerns to the heads of municipalities.
Ildar Shakirov, the deputy head of
the Executive Committee, told about the possible consequences of the new draft
law acceptance and proposals for its improvement.
As the first problem question he
named the organisation of mobile trade. According to the draft law the members
of the Russian Federation are called upon to implement the process of issuing
certificates for mobile trade. However the requirements to safety, city
appearance and serviceability of such objects in offered edition of the draft
law are rather common, at the same time they are identical both for
settlements, and for megapolis. Because of insufficient control such approach
will increase the number of mobile trade objects which will not correspond
neither safety requirements, nor the
city appearance. «The process of issuing certificates for mobile trade should
be solved on the level of municipalities», - noted I.Shakirov.
One more problem question is the
dismantling of illegal trade objects at the territory of apartment houses and private territories. The
acceptance of the draft law in offered edition will increase the number of
illegal shops. It was necessary to obtaine from the residents of multi-room
houses their consent to the deployment of such objects, he reminded. However
many unfair businessmen ignore it, and
only the court can solve this problem, but this process takes several months.
«Our proposal is to amend the law and to settle the question of to eliminate
illegal shops», - added I.Shakirov.
Also there will be a place which is
remained unimplemented twice in bidding processes. It gives rise to serious
concerns to us. According to Shakirov, such places will become the places for
illegal trade.
According to the opinion of
drafters, the popular places of trade will improve the financial position of
farms and smallholders, however dealers manage marketing of their production,
added the deputy head of the Executive Committee. Moreover in Kazan the special
sites are organised for realisation of farmer production - there are 9 tent
fairs in the city which meet the requirements.
As Ildar Shakirov told: «Because of
small business support programmes the new draft law in offered edition can take us back to the
past when the trade was conducted without supplying of elementary safety
norms».
I.Shakirov emphasised the important
functions of non-stationary trade objects (NTO) which offered products to consumers and saled
seasonal goods. But there are the largest number of violations in
non-stationary trade. The most common one is the sale of poor-quality products,
infringing goods, illegal connection to power resources of multi-room houses,
violation of the rules of places improvement.
Due to hard work and local rules in
recent years in Kazan we managed to
clean up the business environment of non-stationary trade, speaker emphasised.
So, today the plans for the placement of NTO approved in Kazan previously discussed by business-community, a
system of property rights provides for secure, transparent and accessible to
all market participants on a competitive basis. Besides requirements to the
city's appearance and NTO project for
the adjustment have been elaborated and approved. The contracts on placement of
250 places have been made, to the end of the spring it is planned to realise
all requirements of NTO placement of 740 places.
Helena Lapushkina, the head of Samara: «Municipalities should maintain a
register of mobile NTO»
Helena Lapushkina, the head of
Samara, offered to create and maintain a register of mobile NTO which the
municipality will grant the certificate about the trade implementation of
trade. «It will allow to organise effective control and regulation of mobile
trade on the territory of particular city territory», - said H.Lapushkina. She
entirely supported the proposal of exclusion of «popular place» from the draft
law, and noted that such approach would bring about problems on sanitary
content of grounds maintenance.
Ilgiz Nasyrtdinov, the deputy head
of Ufa, noted it was necessary to provide norms for the issue of dismantling
the illegal located objects and simplifying
the procedure. «We believe that there is no necessary detailed consideration of
the procedure in this project», - said I.Nasyrtdinov.
The issue of NTO placement on
private territories and on territories beside multi-room houses gave rise to
serious concerns, added Alexey Maklygin, the deputy head of Cheboksary. «It is
necessary to work more extended description of criteria for NTO objects. Today
city infrastructure changes, new decisions are required», - considers the
deputy head of Cheboksary.
As a result it was offered to convey
a motion to the State Duma of the Russian Federation on behalf of the
Association of Volga region cities. The draft law should take into account the
opinion of local authorities who regulate these questions in their regions and
cities. «Some provisions of the new draft law will be beneficial for
unscrupulous businessmen, - said the Mayor of Kazan. - It is that case, when
the voice of cities and municipalities should be heard».
Oleg Bekmemetev, the head of Izhevsk, Victor Kuvajtsev, the head of Penza,
Michael Isaev, the head of Saratov, Lyudmila Andreeva, the deputy head of the
Kazan Municipality, Iskander Giniyatullin, the deputy chairman of the Executive
Committee, Elvira Dolotkazina, the deputy head of Nizhnekamsk, Ekzam
Gubaidullin, the chairman of the Council of Municipalities of the RT, and
others also attended the meeting.
